Malta AI Guidance Puts Human Oversight At The Forefront

The Malta Gaming Authority (MGA) and Malta Digital Innovation Authority (MDIA) have introduced a new AI Gaming Charter for Malta’s gambling industry.

The voluntary framework aims to guide operators as they adopt artificial intelligence. It also complements existing rules, including the European Union’s AI Act and the General Data Protection Regulation (GDPR).

Human oversight remains a key part of the Charter. The guidance says AI should support human judgement rather than replace it. This approach is especially important for sensitive areas such as account restrictions and responsible gambling interventions.

For higher-risk AI systems, the Charter encourages operators to keep detailed records. It also recommends clear escalation procedures and regular system checks.

In addition, operators should make AI interactions clear to players. Players should know when they are communicating with an AI-driven system. The guidance also covers AI-generated content, including deepfakes, which should follow relevant EU AI Act requirements.

The Charter covers several gambling applications. These include customer-facing chatbots, fraud detection, anti-money laundering systems, responsible gambling tools, recommendation engines, player onboarding and know-your-customer processes.

Furthermore, operators are encouraged to keep an inventory of their AI systems. They should also determine whether they act as providers or deployers under the EU AI Act.

The guidance also addresses the environmental impact of AI. The MGA and MDIA recommend that operators consider energy efficiency, supplier practices and carbon footprints when deploying AI technologies.

However, the Charter does not create new legal obligations. Instead, it provides practical guidance as gambling companies continue to integrate AI into operational and player-facing systems.
