Sweden Redefines Gambling Act Against Illegal Operators

The Ministry of Finance published investigator Marcus Isgren’s report, outlining new measures that have been incorporated to address the flaws in existing systems, enhance consumer protection, secure state revenues, and crack down on illegal operators.

Isgren’s report emphasised the need to shift to “participant criterion” from “directional criterion”, highlighting that the new rule prevents the illegal sites from granting access to Swedish players, irrespective of their approach to capture the market. 

The “participant criterion” approach meant this law applies to Swedish users whenever they can access and play. 

Finance Markets Minister Niklas Wykman announced the Gambling Act review in February 2025, intending to impose strict restrictions against unlicensed operators and illegal sites.

Minister Wykman highly supported Isgren’s submission, calling it “a crucial step in creating a safer and fairer gambling market”. The report was further acknowledged by BOS, which has been a longtime critic of the Gambling Act.
